Delta-8 THC 101
First things first: what is delta-8 THC? It’s one of the primary active ingredients in both hemp and cannabis.
You can think of delta-8 THC as the twin sibling of ‘regular’ delta-9 THC. Both cannabinoids have the very same chemical makeup and chemical formula. Their only difference? A single chemical bond — but this bond makes all the difference when it comes to their mental effects, health benefits, and legal status.
Delta-8 THC users say that this cannabinoid provides a gentler, more ‘refined’ high than alternatives. It usually comes without delta-9 THC’s common side effects, including couchlock, the munchies, dry mouth, et cetera. Many experts call delta-8 ‘THC lite.’
Delta-8 THC also possesses some pretty unique health benefits. According to the National Cancer Institute, D-8 may possess “anxiolytic, antiemetic, appetite-stimulating, analgesic, and neuroprotective properties.”
Growing bodies of research shows that delta-8 THC provides many of the same effects as both CBD and THC. It’s uplifting, and relaxing…anti-inflammatory, and anti-stress. How does D-8 work so holistically? This same research shows that delta-8 THC can bind to both types of endocannabinoid receptors, while CBD and THC only bind to one or the other.
Is delta-8 THC legal?
Delta-8 is indeed federally legal, despite its ability to uplift and get people ‘high.’
That might seem strange at first, given that ‘regular’ THC is illegal in many states and at the federal level. What makes delta-8 different?
It’s all a matter of sourcing. 2018’s Federal Farm Bill (yes, the same one that legalized CBD) also legalized every single hemp-derived cannabinoid besides delta-9 THC. The Farm Bill’s fine print essentially allows a legal loophole for delta-8 THC, delta-10 THC, THCv, THC-O, HHC, and more.
This legal loophole has been a blessing in disguise for anyone who lives where medical cannabis isn’t yet legal. Thanks to delta-8’s legality, almost anyone over the age of 21 can find the upliftment they crave!
Is delta-8 THC legal in Florida?
Delta-8 THC isn’t just legal on the federal level. It’s also 100% legal in Florida! Here are the details.
- Hemp derived delta-8 is legal in Florida, so long as it’s derived from industrial hemp containing less than 0.3% THC.
- Delta-8 is legal to enjoy, sell, possess, distribute, and even produce (though you may need special licensing for certain types of production/extraction)
- CBD, THCv, delta-10 THC, etc are also legal in Florida
- Delta-8 THC is legal to purchase online
- Delta-8 THC is legal to to travel with
Delta-8 THC’s federal legalization is backed by Florida’s state legislature. Florida Senate Bill 1020 states that “ all hemp derivatives, [including’ cannabinoids, terpenes, flavonoids, and all other compounds” are legal throughout the state. These substances are now removed from Florida’s Drug Abuse Prevention and Control Act.
Even though hemp-derived delta-8 is legal in Florida, cannabis use remains highly regulated. Medical cannabis gets the greenlight — but recreational cannabis use is strictly off-limits.
Using, possessing, selling, or cultivating cannabis can result in serious pentalities. Possession of as little as 20 grams of cannabis is a misdemeanor punishable by up to one year of jail time or fines of up to $1,000. While medical cannabis is legal per Amendment 2 and Senate Bill 8A, only those with medical cannabis cards may partake.

While delta-8 is for sale — and legal — throughout Florida, we should go over a few potential limitations. Delta-8 may not be legal at certain institutions or businesses. Also, if you’re traveling with delta-8 flower or other products, it’s probably a good idea to bring some COA’s/lab tests along to avoid any potential problems with law enforcement.

- Clearwater Beach
Virtually all of these hops sell a variety of delta-8 THC products, inlduing gummies, vapes, distillates, and more.
Delta-8 THC: is it popular in Florida?
It sure is! So popular, actually, that it might just overshadow CBD soon.
One smoke shop owner tells the Miami New Times that delta-8 products are “flying off the shelves.”
Some customers are even buying delta-8 pre-emptively, after seeing how it’s been banned in other states. “They’ll buy an extra bag [or] two bags of gummies, just to hold them down,” the businessowner says.
At another store, VaporFi, over 350 delta-8 products grace the shelves. Among these many offerings are blunts, brownies, and delta-8-infused chocolate chip cookies.
All this popularity is occurring at the same time as growing legal tensions. A FL senate bill filed last November is trying to raise the age requirements for buying D-8 from 18 to 21. This same bill is also trying to make businesses register their delta-8 products with the state, which may reduce access to this special cannabinoid in the long run.

Why all these legal restrictions? Largely because delta-8’s legality makes it difficult for law enforcement — delta-8 products tend to look, taste, and smell just like less legal delta-9 products.
If you live in a state where D8 is illegal, don’t worry. We simply won’t ship to you there!
