It’s all a matter of sourcing. 2018’s Federal Farm Bill (yes, the same one that legalized CBD) also legalized every single hemp-derived cannabinoid besides delta-9 THC. The Farm Bill’s fine print essentially allows a legal loophole for delta-8 THC, delta-10 THC, THCv, THC-O, HHC, and more.

Delta-8 THC isn’t just legal on the federal level. It’s also 100% legal in Florida! Here are the details.
Delta-8 THC’s federal legalization is backed by Florida’s state legislature. Florida Senate Bill 1020 states that “ all hemp derivatives, [including’ cannabinoids, terpenes, flavonoids, and all other compounds” are legal throughout the state. These substances are now removed from Florida’s Drug Abuse Prevention and Control Act. [3][4]
Even though hemp-derived delta-8 is legal in Florida, cannabis use remains highly regulated. Medical cannabis gets the greenlight — but recreational cannabis use is strictly off-limits.
Using, possessing, selling, or cultivating cannabis can result in serious pentalities. Possession of as little as 20 grams of cannabis is a misdemeanor punishable by up to one year of jail time or fines of up to $1,000. While medical cannabis is legal per Amendment 2 and Senate Bill 8A, only those with medical cannabis cards may partake. [5][6]

All this popularity is occurring at the same time as growing legal tensions. A FL senate bill filed last November is trying to raise the age requirements for buying D-8 from 18 to 21. This same bill is also trying to make businesses register their delta-8 products with the state, which may reduce access to this special cannabinoid in the long run. [7]
